Terms of Use
Last updated:
These terms explain the rules for using Drowzy, and the limits of what an automated drowsiness-detection app can do. Please read them, especially the sections on limitations and responsible use.
Agreement
These Terms of Use (“Terms”) apply to the Drowzy mobile app (the “App”) and this website (together, the “Service”), provided by Drowzy (“Drowzy”, “we”, “us”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service. Our Privacy Policy explains how we handle your information.
What Drowzy does
The App uses your phone’s front camera and on-device computer vision to look for facial and eye cues that may indicate drowsiness while you drive, and gives an audible and vibration alert when it identifies possible signs of drowsiness. The App can also keep a history of your trips.
Drowzy is a driver-awareness aid. It is not a medical device, it does not diagnose or treat any condition, and it is not a vehicle safety system or a substitute for adequate sleep and rest.
Limitations of detection
Automated drowsiness detection has real limits. In particular:
- The App may not detect every instance of drowsiness, and it may sometimes alert when you are not drowsy.
- Detection can be affected by lighting, camera position, glasses or sunglasses, obstructions, device performance, battery level, and other conditions.
- An alert may come too late to prevent harm. Drowsiness can impair driving before any sign is detectable.
- The App does not control your vehicle and cannot prevent an accident.
You remain fully responsible for your driving, for deciding whether you are fit to drive, and for complying with traffic laws at all times.
Responsible use
- Get adequate rest before driving. Don’t use Drowzy as a reason to keep driving while tired.
- Mount your phone securely, and set up and start the App before you begin driving.
- Never hold or interact with your phone while driving.
- Position your phone so it doesn’t block your view of the road or interfere with vehicle controls or airbags.
- If you feel drowsy or the App alerts you, stop somewhere safe and rest.
- Follow all local laws about the use and mounting of mobile devices in vehicles.
Eligibility and accounts
You must be at least 13 years old to use the Service, and old enough to agree to these Terms where you live (or have a parent or guardian agree on your behalf). You may use some features as a guest. If you create an account, you’re responsible for keeping your login details secure and for activity under your account. You can delete your account at any time from within the App.
Free trials and subscriptions
Some features may require a paid subscription. Where subscriptions are offered:
- New users may be offered a free trial. Trial length and eligibility are shown in the App before you start.
- Subscriptions are offered for the periods and prices shown in the App, and renew automatically unless cancelled.
- Payment is charged to your Apple or Google account. You can manage or cancel your subscription in your account settings with Apple or Google. Cancellation must generally happen at least 24 hours before the end of the current period to avoid renewal, and takes effect at the end of that period.
- Refunds are handled under the policies of Apple or Google, as applicable, except where applicable law requires otherwise.
Acceptable use
You agree not to:
- Use the Service in a way that distracts you while driving or breaks traffic or other laws.
- Copy, modify, reverse-engineer, or attempt to extract the source code of the App, except where the law allows it.
- Interfere with or disrupt the Service or the systems it runs on, or try to access them without permission.
- Use the Service for any unlawful, harmful or fraudulent purpose.
Intellectual property
The Service, including the Drowzy name, logo, design, software and content, belongs to Drowzy or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose under these Terms.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. We do not promise that the Service will be uninterrupted or error-free, or that drowsiness detection will be accurate in every situation. Nothing in these Terms limits rights you have under consumer laws that cannot be excluded.
Limitation of liability
To the extent permitted by law, Drowzy will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the Service. To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
Suspension and termination
You can stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or where we need to for legal or security reasons.
Governing law
These Terms are governed by the laws of Nigeria, without regard to conflict-of-law principles, except where the law of your country of residence requires otherwise.
Changes to these terms
We may update these Terms from time to time. We’ll post the updated version here and change the date at the top. If you keep using the Service after changes take effect, the updated Terms apply.
